Terms of Service
All sales of goods through the online store ya-man.hk operated by Better Life (Hong Kong) Holdings Limited and/or its affiliates are subject to the terms and conditions set forth on this page (hereinafter referred to as 'these Terms and Conditions'). By using this website and placing orders hereunder, you acknowledge your acceptance of these Terms and Conditions. All references to 'we' in these Terms and Conditions refer to 'Better Life (Hong Kong) Holdings Limited'.

In the event of any conflict between the Chinese and English versions of these Terms and Conditions, the English version shall prevail.

Sale of Goods
Under these Terms and Conditions, we will sell and you will purchase the goods specified in your order placed on this website (hereinafter referred to as the 'Order') (hereinafter referred to as the 'Ordered Goods').
We only accept Orders for delivery within the Hong Kong Special Administrative Region (hereinafter referred to as 'Hong Kong').
As it is illegal to sell alcoholic beverages to persons under the age of 18, we only sell alcohol products to individuals who are at least 18 years old. By placing an Order, you confirm that you are at least 18 years old. You must ensure that your account is not used by others to purchase alcohol products. The delivered goods must be received by a person aged 18 or above (with identification required); otherwise, we will withdraw the goods and attempt to deliver them again at another agreed time.
Placing an Order
You may place an Order by completing the electronic order form on this website (hereinafter referred to as the 'Order Form'). Once the Order Form is completed and an order number is assigned, your Order is deemed confirmed, and you may not cancel or modify the Order to the maximum extent permitted by applicable law from that point onward.
The information on this website constitutes an invitation to offer and should not be considered as our offer to supply any goods.
Your placement of an Order constitutes your offer to purchase the Ordered Goods, which are the subject of the Order. We reserve the right to accept or reject your Order (with or without reason). We do not guarantee that the goods displayed on this website are available for sale at all times.
Upon receipt of your Order, we will send you an email confirming the Order (hereinafter referred to as the 'Confirmation Email'). However, receipt of the Confirmation Email does not mean that we have accepted your Order, nor does it constitute our confirmation of the offer to sell. We merely notify you that we have received your Order.
Since we need to ensure the availability of the Ordered Goods, we will only accept the Order when the Ordered Goods are ready for delivery. In most cases, items in stock will be accepted for Order within seven days. We reserve the right to refuse or cancel any Order and limit the quantity ordered. Prior to accepting or processing any Order, we may require customers to provide additional proof of information. After receiving our Order confirmation email, you can track your Order status via 'Contact Us.' For more details, please see the 'Order Tracking' page.
When your Order is ready for delivery, it means we have accepted your Order, and a legally binding contract for the sale of the Ordered Goods has been formed between us (hereinafter referred to as the 'Contract'). The Contract supersedes all prior communications, understandings, and agreements between the parties.
You must ensure that all information provided in the Order, including but not limited to the delivery address and your contact information, is accurate. If we are unable to deliver or there is a delay in delivery or if we are unable to fulfill other obligations and/or responsibilities under the Contract due to incomplete and/or inaccurate information provided by you regarding the Order, we shall not be held liable.
Payment Terms
All prices listed on this website are in Hong Kong dollars. We reserve the right to change product prices on this website at any time and correct unintentional pricing errors. In the event of a pricing error, we will notify you and allow you to choose to proceed with the transaction at the correct price or cancel your Order without charge.
We further reserve the right to adjust prices to reflect changes in the cost of the Ordered Goods caused by unforeseen circumstances beyond our reasonable control, including fluctuations in foreign exchange rates, currency regulations, changes in taxation, changes in fees, labor and material costs or other production costs, (at your request) delivery routes, or your delay/inability to provide necessary information to us.
Unless otherwise specified by us, payments shall be made in Hong Kong dollars via Visa or MasterCard credit cards.
After issuing the Confirmation Email to you, we will deduct the payment for the Ordered Goods from your designated credit card.
Your credit card transaction will be processed by our appointed service provider (hereinafter referred to as the 'payment processor'). When making a credit card transaction, all payment information passing through the bank payment gateway will be encrypted.
We are not responsible for any loss or damage directly or indirectly caused by:
During online payment, your omission or negligence results in others seeing or otherwise obtaining your personal data;
During online payment, your negligence results in failure to provide accurate information;
Other reasons related to this specific payment method.
Personal Data and Privacy
Our Privacy Policy and Cookies Policy published on this website explain how we treat your personal data and protect your privacy when you use this website. By providing us with the data required for your order, you agree that we can use this data in accordance with that Privacy Policy.

Delivery of Ordered Goods
According to item 2, we will deliver the ordered goods to the address you specify within the delivery area (see definition below) (hereinafter referred to as the 'delivery address') on the date specified in the confirmation letter (hereinafter referred to as the 'delivery date'). We generally deliver Monday through Saturday (excluding Hong Kong public holidays) from 11:00 AM to 6:00 PM. To avoid doubt, we will not accept any deliveries outside the delivery area. For the purposes of item 5, the 'delivery area' means any location within Hong Kong, excluding outlying islands, Lantau Island, Ma Wan, Tung Chung, Discovery Bay, restricted areas/zones requiring specific permits or licenses to enter or exit, and other locations we may from time to time determine at our discretion (hereinafter referred to as 'non-applicable areas').
If the total order amount is over HK$600 and the delivery address is within the delivery area, we will provide free delivery. If the total order amount is less than HK$600 and the delivery address is within the delivery area, we will charge a delivery fee of HK$60 per order. If the delivery address is within the non-applicable areas, we will charge a delivery fee on a case-by-case basis.
To avoid doubt, delivery fees already paid to us (if any) cannot be used to offset installation fees or other payable service fees (if applicable).
We reserve the right to change any delivery service terms (including but not limited to delivery areas and delivery fees) from time to time without further notice. After confirming the order according to item 4, all paid delivery fees are non-transferable, non-refundable, and cannot be exchanged for cash or goods.
We will make every effort to deliver within five working days from the confirmation letter date. Nevertheless, the delivery date of the ordered goods is not essential to the contract and is only our best estimate. We reserve the right to change the delivery date from time to time with reasonable prior notice, and you must accept delivery on our proposed updated delivery date. In any event, we are not responsible for any delay in the delivery of any ordered goods (regardless of cause and whether or not you were notified). For the purposes of item 5, 'working days' means days other than Saturdays, Sundays, Hong Kong bank holidays, or public holidays.
To protect your rights and record delivery, upon arrival of the goods, we may, at our discretion, require you or your authorized representative to show their original ID or identity document and written authorization (if applicable) and other documents for identity verification. If you fail to properly comply with our requirements, we reserve the right to refuse delivery.
You must receive the ordered goods on the delivery date or (as applicable) the updated delivery date. If you cannot receive the ordered goods as scheduled and do not notify us at least 48 hours before the delivery date or updated delivery date, without prejudice to our other rights and remedies, we have the right to decide:
to store the ordered goods at a location we determine until the actual delivery date and claim from you all costs incurred thereby (including but not limited to storage fees and insurance) and expenses and charge an administrative fee of HK$200 for each subsequent delivery; or
to cancel your order and claim from you all costs and expenses incurred thereby, in which case the total amount you have paid for the order will be forfeited, and you should immediately pay any outstanding balance.
Transfer of Risk and Ownership
Upon arrival of the ordered goods at the delivery address, the risk of the ordered goods shall immediately transfer to you. Notwithstanding anything herein, we are not responsible for any damage to the ordered goods caused by any act, negligence, or any event beyond our reasonable control (including but not limited to fire and water).
Notwithstanding any other descriptions in this article, the ownership of the ordered goods will not be transferred to you until you have paid the full amount of the order, even if the ordered goods have been delivered and the risk or any other obligations have been transferred to you.
Return of defective goods
Unless you return the written notice of error and description of the error along with the goods to us within 96 hours after the ordered goods have arrived at the delivery address. Otherwise, it shall be preliminarily deemed that we have fulfilled all our responsibilities under the contract, and you confirm that the delivered goods are correct and satisfactory in quality. If you fail to comply with the above claim period, unless you can adequately explain the reasons to us and prove that you have made the claim as soon as possible, any late claims will not be accepted.
If a claim under Item 1 is sufficiently evidenced, we have the right to decide:
To replace the ordered goods free of charge according to these terms (especially Items 3 and 7.5); or
After you return the ordered goods, refund the payment for the ordered goods to you according to these terms (especially Items 4 and 7.5).
Without prejudice to any content of the contract, you shall bear all costs and expenses incurred from returning the goods under Item 1 and delivering replacement goods under Item 7.2.1 (including but not limited to delivery fees, local customs duties). If the ordered goods are replaced under Item 7.2.1, you must choose to pick them up in person or pay an additional delivery service fee.
We reserve the right to determine the method of refund under Item 2.2.
The ordered goods returned under Item 1 should remain in their original unaltered condition and be returned in their original packaging.
If the ordered goods have no defects or faults, or we have made no errors, we will neither issue a refund nor provide a replacement.
The claim and notification for returning goods under Item 1 should be submitted to us through our online service.
We reserve the right to reject any claim under this Item 7. In case of any disputes, our decision shall be final.
Warranty Service
Different products purchased online come with different warranty terms. The warranty period starts from the date the ordered goods arrive at the delivery address and is valid for a specific period (hereinafter referred to as the 'Warranty Period'). The coverage shall be subject to the detailed warranty terms and conditions provided by the warranty supplier.

Among other things, the warranty under this Item 8 does not cover:
Any consumables/parts included with the warranted goods;
Any supplementary accessories that are not parts or components of the warranted goods;
Cosmetic damage to the warranted goods;
Damage caused by force majeure, accidents, misuse, abuse, negligence, unauthorized alterations/modifications, improper handling or operation, incorrect power connection, repairs or attempted repairs by anyone not authorized by the warranty supplier, or normal wear and tear;
Damage not covered by the warranty supplier
If any defects or faults in the warranted goods are found during the warranty period, we will choose to repair or replace the warranted goods free of charge according to the relevant warranty terms and conditions provided by the warranty supplier. However, you must bring the warranted goods to the designated service center at your own expense during the warranty period and retrieve the warranted goods from the service center at your own expense after the relevant repair or replacement (as applicable).
Regardless of any provisions in this Item 8, our liability for any warranted goods during the warranty period is limited to the scope and extent of the warranty provided by the warranty supplier. To avoid doubt, except for liabilities under Item 7 (if applicable), we are not responsible for any errors, damages, or defects in any non-warranted goods at any time. We also do not assume responsibility for any errors, damages, or defects in the warranted goods after the warranty period.
Liability
The contract lists all our obligations and liabilities regarding the ordered goods. Unless explicitly stated in the contract, any warranties, terms, or other clauses are not binding on us. To the maximum extent permitted by law, except for the terms, warranties, and liabilities explicitly stated in these terms and conditions, any terms and warranties implied or expressed by statute, common law, or otherwise, including warranties of merchantability or fitness for a particular purpose, and any additional damages, compensation, or indemnification, are excluded.
Without prejudice to any of the contents herein, our maximum total liability under the contract, whether in contract, tort (including negligence) or otherwise, shall not exceed the amount you paid for the contract.
We do not warrant the accuracy of the information on this website and shall not be liable for any consequences arising from inaccurate information. Any typographical errors, clerical errors, or other errors or omissions in any materials on this site, any sales literature, quotations, price lists, acceptance of offers, invoices, or other documents or information may be corrected at any time without liability on our part.
Our failure or delay in exercising any right, power, or remedy under the contract shall not constitute a waiver of such right, power, or remedy. Any partial exercise of such right, power, or remedy shall not preclude further exercise thereof or the exercise of any other rights, powers, or remedies. Without limiting the foregoing, our waiver of any breach of any provision of the contract by you shall not constitute a waiver of any subsequent breach of that or any other provision.
We shall not be responsible for any inability to perform any obligation or liability directly or indirectly caused by force majeure, fire, flood, accident, riot, war, terrorist attack, government intervention, embargo, strike, labor disputes, epidemic outbreak, equipment malfunction (including but not limited to internet system failures), or any other factor beyond our reasonable control.
Promo Code
To use a promo code, you must enter the code before completing your order. Promo codes can only be used once and cannot be applied to orders already completed. Promo codes offering discounts cannot be combined with other discounts or promotions.
Promo codes are non-transferable and cannot be exchanged for cash or credit.
Promo codes are not applicable to certain items. You may refer to the specific terms of the promo code to see which items are eligible. If you apply a promo code to an ineligible or incorrect item, we reserve the right to cancel your order.
General Terms
You may not assign or transfer any of your rights or obligations under the contract to any third party without our prior written consent.
We reserve the right to modify these terms and conditions from time to time without prior notice.
All promotional offers listed on ya-man.hk are valid only on this website, and we reserve the right to modify the terms and conditions of all promotions at any time.
Each provision of these terms and conditions is severable from the others, and the invalidity of any provision shall not affect the validity of the remaining provisions. If any provision is invalid but would become enforceable if some part were deleted or the amount or period referred to therein were reduced (as applicable), such provision shall be deemed modified, reduced, or shortened as necessary to make it enforceable.
These terms and conditions and any dispute or matter arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with Hong Kong law. In the event of any dispute, both you and we agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.

This page sets out the terms and conditions ("T&Cs") governing all sales and purchases of goods effected through the online shop operated by Ecolite Wellbeing (HK) Holding Limited and/or its affiliates at ya-man.hk (“Website”). Your use of the Website and placing orders thereat shall be deemed to imply your acceptance of the T&Cs. All references in the T&Cs to “we” and “us” shall mean "Ecolite Wellbeing (HK) Holding Limited”.

The T&Cs shall be read in conjunction with the “Legal Notice” posted on ya-man.hk and this Website as both are binding on you (“Legal Notice”). In the event of discrepancy or inconsistency between the T&Cs and the Legal Notice in respect of the sales and purchases of goods effected through the online shop operated by Jebsen Consumer Products Co. Ltd., the provisions of the T&Cs shall prevail. Where there is any conflict between the English and the Chinese version of the T&Cs, the former shall prevail.

Sales and Purchases
Subject to the T&Cs, we shall sell and you shall purchase, the goods (“Goods”) in accordance with the order you placed through the Website (“Order”).
We shall only accept Orders for delivery within the Hong Kong Special Administrative Region (“Hong Kong”).
We shall sell the alcohol products to end user with the age of 18 or above as it is illegal to sell alcohol to people under the age of 18. By placing an order, the Customer confirms that he/she is 18 years old or above. The Customer shall ensure that no person shall use his/her login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery or delivery shall be withdrawn and attempted at another time agreed.
Placing Orders
You may place an Order by filling in the electronic order form available on the Website (“Order Form”). Once an order number is assigned to you after your completion of the Order Form, you are deemed to have confirmed your Order and shall thenceforth, to the fullest extent permitted by the applicable law, neither cancel nor vary the Order howsoever.
Information contained on the Website constitutes an invitation to treat only, which shall not be regarded as an offer by us to supply any goods.
Your placing of the Order shall constitute an offer from you to us to purchase the Goods which shall form the subject of the Order. We shall have sole and absolute discretion to accept or decline the Order without ascribing any reason in respect thereof. We do not guarantee that the goods shown on the Website will be available for sale to you at all times.
 
Once we receive your order, we will email an order confirmation (“Confirmation”) to you. However, your receipt of a Confirmation does not signify we have accepted your order, nor does it constitute as we have confirmed our offer to sell. We are simply confirming that we received your order.
Because we want to ensure that we have your Goods available, we won’t accept your order until we have prepared your Goods for shipping. In most cases this will be within 7 days for items that are in stock. We may, in our sole discretion, refuse or cancel any order and limit order quantity. When your order is ready for shipment, it means that we have accepted your order and form a legally binding contract between us for the sale of Goods (“Contract”). It supersedes all previous correspondence, understandings and agreements between us.
You shall be responsible for ensuring the accuracy of all information provided in connection with your Order, including without limitation, the delivery address and your contact details. We shall not be liable for any failure or delay or otherwise in discharging our obligations and / or performing our duties under the Contract if such default is in any way due to the incomplete and / or inaccurate information provided by you in respect of the Order.
Payment Terms
All prices quoted on our Website are in Hong Kong dollars. We reserve the right to change prices for products displayed on our Website at any time, and to correct pricing errors that may inadvertently occur. In the event of a pricing error, we will notify you of the error and allow you to either proceed with the transaction at the correct price or cancel your order at no cost to you.
We further reserve the right to adjust price to reflect any change in the cost of Goods due to any unforeseen circumstances beyond our reasonable control, including, foreign exchange fluctuation, currency regulation, change in tax, levies, costs of labour, materials or other costs of manufacture, delivery schedule (at your request), or your late instructions or failure to supply us with necessary information.
Unless specified by us otherwise, payment shall be effected in Hong Kong dollars by way of Visa’s or MasterCard’s credit cards.
Payment for the Goods shall be debited from your designated credit card upon our issuance of the Confirmation to you.
Your credit card payment shall be processed by such service provider as we may engage (“Payment Processor”). All payment details entered through the payment gateway of the bank collecting the credit card payment for us shall be encrypted.
We shall not be liable for any loss or damage arising directly or indirectly from:
your failure or omission to protect your personal data from being seen by other persons or otherwise obtained by other persons during the course of effecting the payment online;
any of your omission to provide accurate information in the course of the online payment process; or
other reasons in connection with the specified mode of payment.
Personal Data and Privacy
Our Privacy Policy and “Cookies Policy” posted on this Website explain how we treat your personal information and protect your privacy when you use this Website. By furnishing your information in collection with the Order to us, you agree that we can use those information in accordance with our Privacy Policy.

Delivery of the Goods
Subject to Clause 5.2, the Goods will be delivered to you at your designated address (“Delivery Address”) within the Delivery Zone (as defined below) on such date as specified in the Confirmation (“Delivery Date”). Delivery will normally be made between 11:00 a.m. to 6:00 p.m. on a weekday from Mondays to Saturdays (excluding Hong Kong public holidays). For the avoidance of doubt, we will not make any delivery of Goods to any place that falls beyond the Delivery Zone. For the purpose of this Clause 5, “Delivery Zone” shall mean anywhere within Hong Kong to the exclusion of outlying islands, Lantau Island, Ma Wan, Tung Chung, Discovery Bay and restricted area / zone where entry or access thereto requires specific permit or licence and such other place(s) as we may designate from time to time at our discretion (“Excluded Zone”).
In the event that the total price of the Order is HK$600 or more and the Delivery Address is within the Delivery Zone, we will deliver the Goods to you free of charge. In the event that the total price of the Order is less than HK$600 and the Delivery Address is within the Delivery Zone, we will deliver the Goods to you at a delivery charge of HK$60 per Order. Where delivery of the Goods is to be made to a Delivery Address within the Excluded Zone, such delivery shall be made subject to your payment of a delivery charge as we shall advise.
For the avoidance of doubt, the amount of delivery charge paid to us (if any) shall not be offset against the cost of installation or other services payable by you (if applicable).
We reserve the right to revise any terms of the delivery service (including but not limited to the Delivery Zone and the delivery charge) from time to time without prior notice. All delivery charges paid are non-transferrable, non-refundable and non-exchangeable for cash or goods once the Order is confirmed pursuant to Clause 2.4.
We will endeavor to deliver the Goods within 5 Working Days after the date of the Confirmation. Notwithstanding the foregoing, time of delivery of the Goods shall not be of the essence in the Contract and are only our best estimate. We reserve the right to change the Delivery Date from time to time upon service of reasonable prior notice to you, whereupon you shall accept delivery of the Goods on such revised Delivery Date as we may advise. Under no circumstances shall we be liable to you for any delay (howsoever caused) in respect of the delivery of the Goods (whether or not the same has been notified to you). For the purpose of this Clause 5.5, “Working Day” shall mean a day which is not a Saturday or Sunday or a bank or public holiday in Hong Kong.
To protect your interest and as record of delivery, we will require you or your authorized representative, as the case may be, to produce your / his / her original identity card or identification document and written authorization (if applicable) and such other documents as we may require for verification upon delivery. We reserve the right to decline delivery of the Goods in the event that our request hereunder is not duly complied with.
You shall take delivery of the Goods on the Delivery Date or revised Delivery Date, as the case may be. In the event that you fail to take delivery of the Goods as required hereunder and without notifying us at least 48 hours prior to the Delivery Date or revised Delivery Date, we shall be entitled to, without prejudice to our other rights and remedies and at our sole and absolute discretion:
store the Goods at such place as we shall determine until the date of actual delivery and claim reimbursements from you for all costs (including but not limited to storage and insurance) and expenses thereby incurred and an administration charge of HK$200 for each subsequent delivery; or
cancel your Order and claim reimbursement from you for all costs and expenses thereby incurred, in which event the total price paid for the Order shall be forfeited and any unpaid balance shall become immediately due and payable by you.
Passing of Risks and Title
The risks in the Goods shall pass to you immediately upon delivery of the same at the Delivery Address. Notwithstanding anything contained herein, we shall not be responsible for any damage of the Goods due to any acts, omissions or any acts beyond our reasonable control (including but not limited to fire and water).
Notwithstanding delivery and the passing of risk in the Goods or anything contained herein, the title to the Goods shall not pass until the total price of the Order under which it is ordered has been paid in full.
Return of Defective Goods
We shall be deemed prima facie to have properly performed all obligations under the Contract, and the Goods delivered shall be deemed to be correct and of satisfactory quality, unless notice of fault and the particulars of such fault are given in writing accompanied with the return of the Goods to us within 96 hours from the date of its delivery at the Delivery Address. Any claim not made as aforesaid shall be deemed to be waived and absolutely barred except where you can show to our satisfaction that it was impossible for you to comply with such time limit and that you have made the claim as soon as it becomes possible to do so.
In the event that a claim is lodged in accordance with Clause 7.1 and subject to satisfactory proof of fault thereof, we shall, at our sole and absolute discretion, either:
replace the Goods free of charge subject to the terms herein, in particular Clauses 7.3 and 7.5; or
refund to you the amount paid for the Goods subject to the terms herein, in particular Clauses 7.4 and 7.5, after your return of the Goods.
Without prejudice to anything contained in the Contract, all costs and expenses arising from the return of the Goods under Clause 7.1 and delivery of the replacement thereof under Clause 7.2.1 (including without limitation, delivery charges, local customs, tariffs and duties) shall be borne by you entirely. If the Goods is replaced pursuant to Clause 7.2.1, you shall be required to either collect the replacement in person or reimburse us for the cost of delivering the same to you.
Refund of payment under Clause 7.2.2 shall be made in such manner as we shall determine at our sole and absolute discretion.
The Goods returned under Clause 7.1 shall be returned in its original unaltered condition and in its original packaging.
We shall not refund or replace any Goods that are not faulty or defective or without any error on our part.
Notice of claim and the return of Goods under Clause 7.1 shall be made to us through our online services.
We reserve our sole and absolute right and discretion to decline any claim under this Clause 7. In the event of any dispute hereunder, our determination shall be final and conclusive.
Warranty Service
There is a different warranty terms concerning different products purchased online. The warranty period hereunder shall commence from the date of delivery of the Goods at the Delivery Address and shall remain valid for a certain period (as the case may be) (“Warranty Period”), which scope shall be subject to the detailed terms and conditions of warranty offered by the Warrantor.

The warranty under this Clause 8 shall not cover, inter alia:
any consumable items / parts supplied with the Warranty Goods;
any accessories not being part or component of the Warranty Goods;
cosmetic damage of the Warranty Goods;
damage due to acts of God, accident, misuse, abuse, negligence, unauthorized alteration / modification, improper handling or operation, improper connection to voltage supply, repair or attempted repair of the Warranty Goods by any person not authorized by the Warrantor, or deterioration due to normal wear and tear; or
damage excluded by the Warrantor.
If any Warranty Goods are found to be faulty or defective during the Warranty Period, we will, subject to the relevant terms and conditions of warranty offered by the Warrantor, arrange at our option to either repair or replace such Warranty Goods at no additional costs to you, provided that you shall take the Warranty Goods to a designated service center within the Warranty Period and collect it from the same after completion of the relevant repair or replacement (as the case may be) at your own cost.
Notwithstanding anything contained in this Clause 8, the extent of our liability in respect of any Warranty Goods during the Warranty Period shall be limited to the extent and scope of warranty offered by the Warrantor. For the avoidance of doubt, we shall not be liable for any fault, damage or defect of any non-Warranty Goods at any time save and except only for obligations under Clauses 7 (if applicable), or be liable for any fault, damage or defect of any Warranty Goods after the expiration of the Warranty Period.
Liability
The Contract sets out the full extent of our obligations and liabilities in respect of the Goods and there are no warranties, conditions or other terms that are binding on us except as expressly stated in the Contract. Any conditions and warranties, whether express or implied by statute, common law or otherwise, including warranties of merchantability or of fitness for a particular purpose, and any additional damages, compensation or indemnification, other than such conditions, warranties and liabilities as are expressly provided for in the T&Cs, are, insofar as and to the fullest extent permitted by law, expressly excluded.
Without prejudice to anything contained herein, our maximum aggregate liability under the Contract, whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount paid by you under the Contract.
We give no warranty as to the accuracy of the information contained on the Website and accept no liability arising from any inaccuracy of the information therein contained. Any typographical error, clerical or other error or omission on the Website, any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by us shall be subject to correction at any time without any liability on our part.
No failure or delay by us in exercising any right, power or remedy under the Contract shall operate as a waiver thereof, nor shall any single or partial exercise of the same preclude any further exercise thereof or the exercise of any other right, power or remedy. Without limiting the foregoing, no waiver by us of any of your breach of any provision of the Contract shall be deemed to be a waiver of any subsequent breach of that or any other provision of the same.
We shall not be liable for any default of obligations or duties directly or indirectly caused by or resulted from acts of God, fire, flood, accident, riot, war, terrorist attack, government intervention, embargoes, strikes, labour disputes, equipment failures (including but not limited to internet system failure), or any other causes beyond our reasonable control.
Promo Codes
To apply a promo code, you must enter it prior to completing your Order. You may apply a promo code once only and cannot apply to previously placed Orders. Promo codes that offer a percent off may not be used in combination with other discount or promotion.
Promo codes are not transferable or redeemable for cash or credit.
Certain Goods are excluded from promo code. You should check the specific details of the promo code to which the Goods it applies to. We have the right to cancel your Order if you apply promo code to excluded or wrong Goods.
General Terms
You shall not assign or transfer any rights or obligations under the Contract to any third person without our prior written consent thereto.
We reserve the right to amend the T&Cs from time to time without prior notice to you.
All listed offers on ya-man.hk are only applicable to the Website, and we reserve the right to amend all offer T&Cs without prior notice.
The provisions contained in each clause of the T&Cs shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. If any of those provisions is void but would be valid if some part of the provision were deleted, or if the amount or duration (if applicable) mentioned in the provision was reduced or shortened, the provision in question shall apply with such modification, reduction or shortening as may be necessary to make it valid.
The T&Cs as set out herein and any dispute or matter arising from the Contract shall be governed by and construed in accordance with the laws of Hong Kong. Both you and we shall submit to the non-exclusive jurisdiction of the Hong Kong courts.
